Arbitration
While the decision-making is passed to a third person, Arbitration maintains many of the favorable attributes of mediation. It is private, expeditious, economical and offers substantial finality. Unlike court, the parties can select their own arbitrator based upon the person's qualifications, knowledge, experience, skill and expertise - a valuable right not available in presenting matters in court. It is less formal than court proceedings and allows the parties to speak directly to the decision-maker without being rigidly bound by the institutional barriers of the court: the Rules of Evidence, cross-examination, and the requirement of redundancy of expert witnesses.
Arbitration is useful as a dispute resolution tool in many ways. First, it provides a vehicle for the initial determination of issues on which the parties are not able to reach agreement. It also may be an impasse-breaker for minor issues when the parties have resolved the principle issues by mediation. It can summarily dispose of issues of language in court documents or in extending the agreements of the parties to related matters or assets not previously identified or in which there is a third party interest. The use of Mediation-Arbitration can afford a choice to parties who seek a fair resolution without requiring presentation of their case on any of the crowded, contested court calendars.
